Spanish Digital Nomad Visa: Conditions
Here are the requirements you will have to fulfill to obtain a visa:
- Country of origin. Non-EU members are eligible for the program!
- Employer. You can apply if you work remotely full-time for a non-Spanish company or foreign customers as a self-employed person. If you are an entrepreneur who can run your business remotely, you are eligible as well. To make things clear, you should make at least 80% of your profits from sources abroad.
- Work online. You will need to provide proof of your ability to work remotely.
- Employment duration. You will need to provide documents which prove that you have been completing orders for non-Spanish customers for at least 3 months before application. If you are a full-time employee, the company you work for should be in existence for at least one year.
- Residency. If you have been a Spanish resident for 5 years or more at the time of application, you will be turned down. If you apply for a visa in Spain, you cannot be staying in the country illegally at the time of application.
- Proof of education. If you apply for a Spanish digital nomad visa, you will have to prove your qualifications and 3 years of experience in the relevant field. A diploma of higher/professional education will be sufficient.
- Income. Eligible applicants for the Spanish visa should earn an income that equals 200% of the minimum wage earned by comparable professionals in Spain. In January 2023, the minimum monthly wage in Spain amounted to 1,166.67 euros, which means that the minimum threshold for a digital nomad is 2,334 euros a month or 28,000 euros a year. The Spanish minimum wage is revised on an annual basis, so follow the updates or check it up with our experts.
- Insurance. You need to have private health insurance to obtain a Spanish visa.
- Trustworthiness. If your criminal record is not clean in Spain or in other countries of your residence 5 years prior to application, you will be rejected.
Obtaining Visas for Relatives
You can get digital nomad visas for the whole family: your spouse and children will be added to the application as dependents. However, this requires the main applicant to prove a higher income, and the dependents should comply with all the above requirements except for professional ones.
If you add a spouse to the application, you should additionally earn 75% of the minimum monthly wage (875 euros a month) to be eligible. If you add any other family member, you will need to earn 25% of the Spanish minimum wage (292 euros a month).
How to Apply
There are two possible ways:
- You can arrive in Spain on a tourist visa and apply for a digital nomad visa in the first three months of your stay.
- You can file your application to the Spanish embassy (consulate/diplomatic mission) in your country of residence.
It is natural that all clients want to know how long it takes to obtain a visa. However, the program is new and there are no official deadlines set. We can rely on the statistics provided by Spanish law and immigration companies who help people with this matter: they say that the procedure takes from 20 days to 3 months from the date you have collected all the required documents.
Visa Validity Term and Resident Card
The Spanish visa for digital nomads is initially granted for a year (or for the period of employment indicated by the applicant if it is shorter). It can be extended, though, and the total period during which you can live and work in Spain under this visa is 5 years.
You will need to comply with certain requirements to keep your visa valid: you cannot live outside Spain for more than 6 months, and you should become a Spanish tax resident.
You can apply for a Spanish resident card that will give you the right to travel to the EU countries while you live in Spain.
Tax Benefits for Digital Nomads
If you stay in Spain for 183 days a year or more, you will automatically be considered a Spanish tax resident no matter what country or company you work for.
Spain gives digital nomads the right to take advantage of a reduced income tax rate in the first four years of living and working in Spain if their income does not exceed 600,000 euros in the fiscal year: they can pay 15% instead of the standard rate of 24%.
